Terms and Conditions

for the LUBOÉ online shop

§1 Scope

These Terms and Conditions apply to all orders placed by consumers through the LUBOÉ online shop.

§2 Conclusion of Contract

The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to order.

By clicking the "Buy Now" button, the customer submits a binding offer to conclude a purchase contract.

The contract is concluded once an order confirmation is sent by email.

§3 Prices and Payment Terms

All prices are stated in euros and include statutory VAT.

  1. Shipping costs Germany Free shipping on orders of €75 or more. Below this amount, a shipping fee of €4.90 applies.
  2. Shipping costs EU €13.

The following payment methods are offered:

  • Credit card (Visa, Mastercard, American Express)
  • PayPal
  • Klarna
  • Apple Pay
  • Google Pay

Payment is due immediately upon conclusion of the contract.

§4 Shipping Terms

Shipping is carried out within Germany as well as to selected countries within the European Union.

  1. Delivery time Germany 2–5 business days
  2. Delivery time EU 3–7 business days

The delivery period begins upon receipt of payment. Shipping is carried out via GLS.

LUBOÉ bears the shipping risk until the goods are handed over to the customer.

§5 Retention of Title

The goods remain the property of LUBOÉ until paid in full.

§6 Right of Withdrawal

Consumers have a statutory right of withdrawal. Details can be found in the separate Right of Withdrawal notice.

§7 Warranty

The statutory warranty rights pursuant to §§ 437 et seq. of the German Civil Code (BGB) apply.

§8 Liability

LUBOÉ is liable without limitation in cases of intent and gross negligence, as well as for injury to life, body, or health. In the case of slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical for this type of contract.

§9 Dispute Resolution

The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

There is no obligation to participate in dispute resolution proceedings before a consumer arbitration board.

§10 Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
